Lots and Interments
All lots are sold in accordance with the provisions of the Laws of the State of New York and shall be used and occupied solely and exclusively for the purpose of sepulture and for no other use whatever. All lots are subject to the conditions and limitations, and with the privileges now or hereafter provided by statute, or specified in the General Rules and Regulations hereby promulgated and as they may be amended, by the Trustees of the Cemetery Board, for the government of the lot owners and visitors to same.
In accordance with the provisions of said laws, all lots shall be indivisible. After burial, the same shall be inalienable, except as otherwise therein provided.
Lots or parts thereof cannot be resold for a profit. The full purchase price a lot must be paid before a deed is delivered or an interment allowed therein.
All lot owners are required to notify the Cemetery Association of any change in address. All notices shall be sent to the last recorded address, and such notice shall be deemed adequate. A person desiring to purchase a lot or to transact any other business must apply at the office of the Superintendent.
Interments in a lot are restricted to those entitled to Burial therein according to Section 1512 of the Not-For-Profit Corporation Laws. Permission for burial of those not entitled to burial according to said Section, must be filed with the Cemetery Association by the Lot Owners.
All interments in shall be single depth except when:
1.The interment of an infant in a casket not exceeding four feet (4′), placed on top of an existing adult burial, provided that the minimum of 18″ of earth covers such interment.
2.Permission is granted by the Cemetery President and sufficient depth is available, or
3.When written permission for double depth burial was granted prior to the adoption and approval of such rules.
A maximum of two cremated remains may be interred in a standard 3.5×10 grave. In no instance shall more than two types of monuments he allowed on a grave.
All interments must be made by employees of the Cemetery Association.
When an order for an interment is made by telephone, the Cemetery Association assumes no responsibility for errors. A written request for burials is received via mail, email, or fax.
All Service orders must be received by the Cemetery office two (2) full working days in advance of the date of the planned commital service. Voicemail messages will not be considered a scheduled service. Management also requires that when scheduling a service that you have all of the completed information required by the office before we can proceed with the request.
No grave shall be opened nor a burial permitted on a Sunday or a Holiday. The Cemetery Associations observes the following Holidays: New Year’s Day, President’s Day, July 4th, Labor Day, Veteran’s Day, Thanksgiving Day and Christmas Day. If in the discretion of the Superintendent, the enforcement of this rule places an undue burden on the interested parties, he may waive compliance thereof.
Lot owners are prohibited from allowing interments to be made on their Lots for compensation,
Disinterments will be allowed only in accordance with the provisions of Section 1510( e) of the Not-For-Profit Corporation Laws. Prior to any disinterment all required permits must be submitted to the Cemetery Office.
All Disinterments at the Cemetery must be conducted by a licensed funeral director, whose fees shall be paid by the lot owner requesting such disinterment.
In addition to required disinterment fees, other fees may be required for the removal of headstones, footstoneS or other objects, and the removal of the foundation. Such fees will be calculated at the cost of performing such services.
The owners of lots may ornament them with flowers but shall not plant or remove any tree without the express permission of the Committee of Superintendence. They shall do nothing which shall be injurious or detrimental to any other lot in the Cemetery. The Trustees reserve the right to trim all shrubbery and remove plants, trees, fences, hedges or other obstructions only with the express permission of the lot owner or in the case of a hazardous condition, after due notice to the lot owner.
The Cemetery Association reserves the right to remove all flowers and wreaths, artificial or natural, and other decorations from lots as soon as they become unsightly.
The Cemetery Association reserves the right, in order to prepare the Cemetery Grounds for the winter months, to remove all potted plants and empty all urns at any time after October 1st in each year.
The Cemetery Association may remove mounds, mausoleums, monuments, effigy or inscriptions which, in the opinion of the majority of the Trustees, is obnoxious, unsightly or dangerous only with the express permission of the lot owner and in accordance with the provisions of Section 1510(g) of the Not-For-Profit Corporations Law.
Glass containers, crockery, tin cans, waste paper boxes, shells, toys, statuary, artificial flowers, balloons and similar articles shall not be permitted on lots or graves as they are inconsistent with the proper appearance of the cemetery.
It shall be the duty of the Superintendent’s Committee to take charge of and to have any desired improvements made, or work done, when necessary, upon a lot at the expense of the owner.
All workmen employed in improving lots must be subject to the control and direction of the Superintendent of the grounds. Persons refusing to conform to this regulation shall be excluded thereafter from the Cemetery.
Monuments
All monuments or markers must be constructed of granite, standard bronze or marble. No monument nor marker of any other stone will be allowed without the permission of the Superintendent.
Each grave is permitted to have first a headstone and second a flush footstone set in accordance with the general plan of the Cemetery. In addition, it shall conform with said plan in size and material.
No monument shall be delivered to the Cemetery Grounds until the foundation is installed, paid for, and ready to receive the same.
Private Mausoleums
The erection of Private Mausoleums may be permitted, provided a design of the same, accompanied by a complete set of plans or specifications be first submitted to the Superintendent, and approved by him and the Board of Trustees.
The exterior of any Private Mausoleum built either entirely or partly above the ground must be of granite or marble.
Private Mausoleums must in all cases be furnished with catacombs so constructed that interments can be made
separately and they must be hermetically sealed at the time of depositing the body.
No Private Mausoleum will be approved for
construction by the Board of Trustees unless a sufficient endowment is set up with the Cemetery Association to provide adequate income to maintain the structure.
Visitors
Owners of lots, with their families, shall have access to the cemetery grounds between the hours of 8:00 A.M. and 5:00 P.M. and in the discretion of the Superintendent atter 5:00 P.M., but no visitors shall be permitted in the Cemetery after sunset. Visitors must in all respects, observe these General Rules and Regulations or any amendments thereto, the violation of which may involve a forfeiture of their privilege.
None but lot owners and members of their families will be allowed in the Cemetery without permission of the Superintendent.
Dogs, and other animals, running at large shall not be allowed on the Cemetery grounds. If any such animal trespasses thereon, the owner will he held responsible for all damages.
